Some of us really want to get back to safer streets. Many servants behave as if they cannot use safer streets. Assisting them is the lame stream media now castigating Militia. This blocks our road back to safer streets in 2010.
Hate is now and has been the stock in trade of the Left. You won’t find hate in Independents, Libertarians and Conservatives; what you will find is the very misleading portrayal of discernment and personal dignity as Hate entirely from the left in America.
One of the current examples is in deprecating what is the Militia in our country along with deprecating the Tea partygoers who have the same discernment of wishing to be out from under the excesses of public servants. In 2010, the Militia within the meaning of the Second Amendment remains as it did in the framing era: the everyman, before the emergence of anything resembling a National Guard about 130 years later.
This was at a time when – in defending the nation by defending your farm and loved ones – there was no one else for a very long time. No Sheriffs, no Police force until the middle 1800’s and no National Guard for generations. Today, in 2010, there is still no one else to protect your life and property. It is very important to understand that in this regard, nothing has changed. In those first moment of an emergency and perhaps even longer, you are on your own.
Courts have held that the duty of police is to deter crime by the arrest of criminals, and the duty of police to protect you is only within certain special circumstances. Those would be psychiatric or criminal incarceration, specific legal protection of the court, or other special conditions such as police guards. It’s worth noting that even under a restraining order of protection from a court, the police are not ordered, the respondent is ordered and police only notified of the order. The order is not made out to the police, it is made out to your stalker. It is the stalker who must observe the court order, not the police.
When it comes to protection of self, of loved ones, and of property, there is no one else. In time of disaster, it has been the citizens who have made a great deal of difference in the first hours.
This is the militia at work, and more people are militia material without even knowing it. When you volunteer in time of local disaster, as many thousands have in time of earthquake or flooding in America, they have become what is the militia. Rescue of others is a part of the overall purpose, because for the time being, there is no one else. They already have that right and that authority to act in rescue.
But volunteers also have the authority to act in protecting their community, and with arms if they deem necessary. This, too, because, for the time being, there is no one else. Congress came to recognize this in passing the Disaster Recovery Personal Protection Act of 2006, making it illegal to confiscate weapons from the people in time of emergency. They could not have done this without recognizing how valuable the armed citizen is to their community. Whether Congress was aware of it or not, it was affirming Militia within the meaning of the second amendment.
Militia is a praiseworthy value of community when, again, there is no one else. Even FEMA reminds us to give them 72 hours before they can get organized, and reminds us to have 30 days’ worth of food and supplies.
Who, then, if not the community?
Remember that Militia within the meaning of 2A is officially recognized as legitimate Militia under Title 10 of the United States Code in spite of several attempts over the years to merge this Militia with what is National Guard. It has never really been done. Volunteers who do not answer to the Commander-in-Chief remain a major component of what might be generically called Militia in 2010 within the original meaning of the term. They remain a major asset to every community by not being answerable to the Commander-in-Chief as the Military is. They are already present, embedded within every neighborhood.
This bugs liberals and was the motivation generations ago to merge the Militia with the Army. It is because volunteers earn and deserve the credit for being what we in EMS call First-in. Volunteers do a magnificent job of several things: they police the area with an authority which already belongs to them (the very authority they grant their own Police force), they can protect their property and community, they effect rescue of others hours and perhaps days before first responders really arrive, they vastly outnumber the professionals in how many people they can reach and help, and the President has been endorsing volunteerism since his inauguration.
Why does the lame stream media malign the Militia as a belligerent force of hate and violence?
